1. Agreement to These Terms
These Terms of Service govern access to and use of the AmbassaTour website, mobile applications, communications, booking tools, tour coordination tools, and related services (collectively, the "Platform") owned and operated by AmbassaTour LLC. By creating an account, booking a tour, serving as an AmbassaTour Guide, participating in a tour, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms are intended to allocate risk as broadly as permitted by applicable law. However, no contract can prevent a person from filing a lawsuit, and nothing in these Terms limits liability or rights that cannot legally be waived.
These Terms form a binding agreement between you and AmbassaTour LLC. In these Terms, references to "AmbassaTour," "we," "us," and "our" mean AmbassaTour LLC.
All right, title, and interest in the Platform, the AmbassaTour name, logos, forms, workflows, software, site content, booking materials, and related intellectual property are owned by AmbassaTour LLC or its licensors. Except for the limited right to use the Platform in compliance with these Terms, no ownership rights are transferred to you.
2. What AmbassaTour LLC Does and Does Not Do
AmbassaTour LLC operates a private marketplace that connects prospective students, family members, and related guests with independent student guides for informal campus-area tours. AmbassaTour LLC is not a university, admissions office, academic advisor, licensed tour operator, transportation provider, security provider, or insurer.
- AmbassaTour LLC does not employ guides as school employees, admissions representatives, or university agents.
- AmbassaTour LLC is not affiliated with, endorsed by, or acting on behalf of any school unless AmbassaTour LLC says so in writing.
- Any statement, opinion, recommendation, or description made by a guide is unofficial information only.
- You agree not to rely on any guide statement as an official representation about admissions, academics, housing, financial aid, university policy, building access, safety, student life, or employment prospects.
3. Eligibility, Minors, and Parent Responsibility
You may use the Platform only if you can form a binding agreement and are legally permitted to participate in the services offered. You must provide accurate information and keep your account credentials secure.
- If a prospective student is under 18, a parent or legal guardian must authorize the booking and is responsible for the minor's compliance with these Terms.
- If AmbassaTour LLC has actual knowledge that personal information is being collected from a child under 13, use of the Platform may require direct parent or guardian consent and may be restricted or denied.
- The parent, guardian, or account holder who books a tour is responsible for all participants included in that booking.
4. Accounts, Accuracy, and Communications
You are responsible for all activity under your account, for ensuring that participant names and contact details are accurate, and for promptly updating your information. You consent to receiving transactional emails, texts, push notifications, and in-app messages related to booking, schedule changes, reminders, and support.
5. Booking, Payment, and No Guaranteed Outcome
Bookings are processed through third-party payment providers such as Stripe. A booking is not final until payment is successfully processed and reflected by the Platform. Prices, taxes, fees, and payout allocations shown at checkout or in the Platform control unless AmbassaTour LLC corrects an obvious error.
- AmbassaTour LLC may refuse, cancel, or limit a booking for safety, policy, fraud, availability, or operational reasons.
- AmbassaTour LLC does not guarantee admissions, scholarships, housing, internships, employment, social outcomes, or any specific experience from a tour.
- Tour timing, route, building access, weather conditions, crowd levels, and guide availability may change at any time.
6. Required Tour Structure and Campus Access Rules
All tours arranged through the Platform must begin at an off-campus meeting location identified by the Platform, the booking details, or AmbassaTour LLC support. Tours may not begin inside campus buildings, private residences, restricted university spaces, or any location prohibited by school policy or law.
- Prospective students and other non-guide attendees are considered the AmbassaTour Guide's campus guests.
- The guide is responsible for supervising the conduct of the guide's campus guests inside campus buildings and for ensuring that guests comply with all applicable school rules, signage, staff instructions, and access restrictions.
- Entering campus buildings is allowed only when the guide reasonably believes such entry is permitted and only for the portions of the tour that comply with school policies, posted rules, and staff direction.
- AmbassaTour LLC does not guarantee that any campus building, classroom, residence hall, office, athletic facility, or other location will be open, available, or lawful to enter.
7. Guide Status, Guide Duties, and Unofficial Information
AmbassaTour Guides are independent users of the Platform and are not school employees, university representatives, admissions officers, security personnel, academic advisors, or official spokespersons. Guides may share personal opinions and lived experience, but all guide communications are unofficial unless AmbassaTour LLC states otherwise in writing.
- Guides must not present themselves as school employees or official representatives.
- Guides must not promise building access, admissions outcomes, policy exceptions, or university approval.
- Guides are solely responsible for their own conduct, statements, route choices, punctuality, guest supervision, and compliance with law and school policy.
8. Participant Conduct and Safety Rules
All users and tour participants must behave lawfully, respectfully, and safely. You may not harass, discriminate, stalk, threaten, trespass, damage property, record in restricted spaces, impersonate officials, consume illegal substances, carry prohibited items, or disrupt campus operations.
- You must follow all school rules, posted signs, building restrictions, and directions from campus staff or law enforcement.
- You are responsible for your own transportation, parking, belongings, clothing, hydration, and weather preparedness.
- If a participant appears unsafe, disruptive, intoxicated, or non-compliant, AmbassaTour LLC or the guide may end the tour immediately without refund to the extent permitted by law and the applicable refund policy.
9. Assumption of Risk and Release
Campus-area tours involve inherent and obvious risks, including walking near streets, bicycles, scooters, stairs, curbs, snow, ice, rain, heat, crowds, construction, uneven surfaces, open public spaces, and changing access conditions. By using the Platform or participating in a tour, you voluntarily assume all risks of participation, whether known or unknown, except to the extent a risk cannot legally be assumed under applicable law.
To the fullest extent permitted by law, you release and discharge AmbassaTour LLC and its affiliates, officers, owners, employees, contractors, and agents from claims arising out of or relating to your use of the Platform, your participation in a tour, your reliance on unofficial information, your interactions with guides or guests, or your presence on or near campus property.
10. Medical, Emergency, and Personal Responsibility
AmbassaTour LLC does not provide medical services, supervision, security services, or emergency rescue. You are responsible for assessing whether a tour is appropriate for you or your guest, including with respect to mobility, weather, health, allergies, medication, and personal safety needs. In an emergency, call 911 or the appropriate local emergency service.
11. Cancellations, Refunds, and Schedule Changes
Cancellations, refunds, credits, and payment reversals are governed by the refund and cancellation terms presented through the Platform. By booking, you agree to those policies. AmbassaTour LLC may reschedule, shorten, reroute, or cancel tours for safety, weather, staffing, campus access, or policy reasons.
12. Disclaimer of Warranties
The Platform and all tours are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AmbassaTour LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, availability, accuracy, and uninterrupted access.
13. Limitation of Liability
To the fullest extent permitted by law, AmbassaTour LLC will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of data, business, goodwill, profits, revenue, opportunities, admissions outcomes, or anticipated savings, arising out of or relating to the Platform or any tour, even if AmbassaTour LLC was advised of the possibility of those damages.
To the fullest extent permitted by law, AmbassaTour LLC's total aggregate liability for all claims arising out of or relating to the Platform or any tour will not exceed the greater of the amount paid to AmbassaTour LLC by you for the specific booking giving rise to the claim or one hundred U.S. dollars (US $100).
14. Indemnification
You agree to defend, indemnify, and hold harmless AmbassaTour LLC and its affiliates, officers, owners, employees, contractors, and agents from and against any claims, demands, actions, investigations, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Platform, your booking, your participation in a tour, your guest's conduct, your breach of these Terms, your violation of law or school policy, or your infringement or misuse of another person's rights or property.
15. Suspension and Termination
AmbassaTour LLC may suspend, restrict, cancel, or terminate any account, booking, or access to the Platform at any time, with or without notice, if AmbassaTour LLC believes doing so is advisable for safety, fraud prevention, legal compliance, payment issues, operational integrity, or policy enforcement.
16. Governing Law, Venue, and Severability
Unless prohibited by applicable law, these Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Unless prohibited by applicable law, you agree that any dispute arising out of or relating to these Terms, the Platform, or any tour will be brought exclusively in the state or federal courts located in Colorado, and you consent to personal jurisdiction and venue there. To the extent a claim is asserted against the owner or operator of the Platform, that claim must be asserted against AmbassaTour LLC, the legal entity that owns and operates the Platform.
If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.
17. Changes to These Terms
AmbassaTour LLC may revise these Terms from time to time. Updated Terms become effective when posted unless a later effective date is stated. Your continued use of the Platform after updated Terms are posted means you accept the revised Terms.
